You can petition the court for Kinship Status of
grandchild if the child has lived with you for 90
days or more.
After the judge decides to give you Kinship status you
will receive a court order giving you such status.  You
must prove to the judge that the child has been with
you for 90 days and that child is happy healthy and well
taken care of.
If you feel that your grandchild is in danger, you can file for a
protection order.  This will give you temp custody until a judge
can hear all sides of the story.  Use facts when filing for this, try
not to use hearsay or accusations, unless they can be backed up.
Example would be probation reports (if you can get one),
copies of any criminal and or civil cases that are pending or
complete, positive drug tests, cps/dhs reports or affidavits
showing the child is in danger.
