PETITION FOR GRANDPARENT VISITATION PRIVILEGES
COMES NOW the Petitioner(s), pursuant to §§ 40-9-1 et set. NMSA 1978 [known as the Grandparent’s Visitation Privileges Act] and respectfully
requests the court to grant me/us Grandparent Visitation Privileges. Here are the reasons for my request:
1. The Petitioner(s) is/are residents of Santa Fe/Rio Arriba or Los Alamos County.
2. The Petitioner(s) is/are the grandparent(s) of , the minor child or children for whom visitation is requested.
3. The parent(s) of the child or children is/are:

4. One of the following conditions exist:
A. One or both of the child [or children] are deceased; or
B. The child [or children] resided with a grandparent for a period of at least three months and the child was less than six years of age at the
beginning of the three-month period, and the child was subsequently removed from the grandparent’s home by the child’s parent or any other person,
and the child’s home state is New Mexico; or
C. The child [or children] resided with a grandparent for a period of at least six months and the child was six years of age or older at the beginning
of the six-month period, and the child was subsequently removed from the grandparent's home by the child’s parent or any other period, and the child’
s home state is New Mexico; or
D. A judgment of dissolution of marriage, legal separation or the existence of paternity has been entered regarding the Respondent(s), and the
visitation requested is not in conflict with the child’s education or prior established visitation or time-sharing privileges.
WHEREFORE, Petitioner(s) requests that the Court order the following:
1. Reasonable permanent visitation privileges to the Petitioners;
2. Reasonable temporary visitation privileges to the Petitioners until the final decision is made; and
3. Such other and further relief as the Court deems appropriate.
